These End User Terms of Service ("Terms") govern your use of the services provided by MindSpire AI ("MindSpire," "we," or "us") for accessing and posting AI-generated content to your social media accounts. You are solely responsible for reviewing and editing any generated content posted to your social media accounts.

You acknowledge that MindSpire AI and its licensors retain all ownership and intellectual property rights in and to the services and any content generated by our AI algorithms. You agree not to copy, modify, distribute, sell, or lease any part of our services or the generated content, unless explicitly authorized by MindSpire AI.

3.2 User Content
By using our services, you grant MindSpire AI a non-exclusive, worldwide, royalty-free license to use, reproduce, modify, and distribute any content you post using our services. This license enables us to provide our services and improve our algorithms.

4. Prohibited Activities
When using MindSpire AI's services, you agree not to:
- Violate any applicable laws or regulations.
- Use the services for any illegal or unauthorized purposes.
- Infringe upon the rights of any third party, including intellectual property rights.
- Engage in any activity that could harm, disrupt, or impair the functioning of our services.
- Attempt to gain unauthorized access to any accounts or systems related to our services.

5. Disclaimer of Warranty
MindSpire AI provides its services "as is" and without any warranty or guarantee. We do not warrant that our services will be error-free, uninterrupted, or secure. You use our services at your own risk.

6. Limitation of Liability
To the maximum extent permitted by law, MindSpire AI and its affiliates shall not be liable for any indirect, incidental, consequential, or punitive damages arising out of or related to these Terms or the use of our services, including but not limited to any account bans, even if we have been advised of the possibility of such damages. You acknowledge and understand that your account may be banned or suspended as a result of your actions or violations of these Terms, and MindSpire AI is not responsible for any such actions or consequences. In using our auto posting service, you specifically acknowledge and agree that MindSpire AI shall not be responsible or held liable in any way for any social media account bans that may occur as a result of using our service. It is your responsibility to ensure compliance with the terms and conditions set forth by the respective social media platforms.

7. Termination
MindSpire AI reserves the right to suspend or terminate your access to our services at any time, without prior notice or liability, for any reason. Upon termination, your right to use the services will immediately cease.

8. Governing Law
These Terms shall be governed by and construed in accordance with the laws of state of Utah, without regard to its conflicts of laws principles. Any dispute arising out of or related to these Terms or the use of our services shall be exclusively subject to the jurisdiction of the courts located in the state of Utah.

9. Modifications to the Terms
MindSpire AI reserves the right to modify or update these Terms at any time without prior notice. Any changes will be effective immediately upon posting the updated Terms on our website or notifying you through other means. Your continued use of our services after any modifications will constitute your acceptance of the revised Terms.

10. Severability
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect. The invalid or unenforceable provision shall be replaced with a valid and enforceable provision that most closely matches the intent of the original provision.

11. Entire Agreement
These Terms constitute the entire agreement between you and MindSpire AI regarding the subject matter herein and supersede any prior or contemporaneous agreements, communications, and proposals, whether oral or written, between you and MindSpire AI.
